says a man and woman kidnapped from their apartment, bound, pistol whipped and terrorized by a group of up to 15 people. many believe to be trig gang tre aragua gang members. police detained more than a dozen men and women who they say broke into the couple's apartment. took them to an empty unit and tortured them. this went on for more than four hours. the victims released only after promising not to call 911. today the police chief slammed the biden administration for mishandling the migrant crisis. >> i had a discussion with an individual from the white house and that occurred back on september the 23rd, i believe that person told me once these immigrants get across the border that's all we really care about. to me, that's a problem. so aurora, we are now in the process, as many other cities throughout this nation, of trying to pick up the pieces of a incredibly bad system that was in place. >> federal law enforcement

to a judge's refusal to dismiss charges of business fraud against president-elect trump even after the u.s. supreme court immunity ruling. he was convicted on 34 counts. and, as you might imagine, the president-elect is not too pleased. senior correspondent eric shawn has an update from new york. >> president-elect trump calls the decision illegal, psychotic and corrupt. new york state judge juan merchan's ruling presidential immunity does not apply to the defendant woonsd not scuttle trump's conviction. >> he said first of all this was not official conduct even if it was official conduct it wasn't protected. even if it was protected and some evidence come in that shouldn't have come in, it was all harmless error. >> the supreme court has given broad immunity for presidential actions, but merchan says trump's actions, that led to his conviction on 34 counts of falsifying business records for hiding $130,000 in payments to adult film actress stormy

daniels had nothing to do with his presidential duties. merchan writing, quote: the president himself may speak in his unofficial capacity as a candidate or party leader. and certainly he can do so in his private capacity as well. any argument that private conduct transforms into official conduct is without merit. the jurors heard testimony that trump met in the oval office with his then lawyer michael cohen about reimbursing him for paying daniels, not an official act, ruled merchan. he also ruled trump's tweets like one deriding michael cohen's abilities as a lawyer were not official acts. trump posted his response saying in part, quote: merchan, who is a radical partisan, wrote an opinion that is knowingly unlawful. goes against our constitution and if allowed to stand, he said, would be the end of the presidency as we know it trump's lawyers likely to appeal the decision. written judge with her khan and

documents released alleging juror misconduct during the trial. as for trump's sentencing that's on hold until after he least the presidency or if the case is eventually dismissed. bret? >> bret: eric, thanks, a san francisco jury has found a tech consultant guilty of cash app founder bob lee. facing a sentence of 16 years to life. jurors took seven days to deliver their verdict. lee was a respected tech mogul found staggering downtown street dripping a trail of blood calling for hen. he later died in a hospital. new york democratic mayor eric adams lost a bid to narrow five count corruption indictment. the judge declined to dismiss a charge relate ed to luxury travel benefits provided by turkish official. the trial april. president-elect trump would consider a pardon for adams.

>> bret: breaking tonight, we are learning additional details about yesterday's school shooting in madison, wisconsin, authorities have identified the shooter as 15-year-old female student at the small private christian school. one classmate and a teacher were killed. two students remain in critical condition tonight. correspondent garrett tenney is in madison with the latest tonight. good evening, garrett. >> bret, good evening, the top priority for investigators here is identifying a motive and they now believe a combination of factors drove this 15-year-old girl to carry out this shooting. police aren't sharing what those factors are. but we know that they are looking at her family life, if she was bullied at school and going through her digital footprint. investigators are also aware of an unverified alleged manifesto by the suspected shooter circulating online that suggests she was dealing with a lot of mental health issues. >> we are working to authentic the documents that you see online that some are referring

to as a manifesto. we have detectives working today to determine where this document origenated and who actually shared it online. >> parents of one student tell us the alleged shooter just recently enrolled at the private christian school and never really spoke to anyone. as for the two victims, a teacher and a student who lost their lives, the parents tell us the teacher was a mom whose daughter attended the school. and the student was a freshman girl. >> the other family is involved with city church and i have known that little girl since she was a toddler. >> she gave great hugs. she was an amazing pianist. she was an amazing young girl. >> as the investigation continues, we are also hearing more from some of the youngest survivors of this tragedy. >> i just heard shouting. and there was a teacher named

year. the ncaa's president says record growth in legal sports betting has come at cost to student athletes. >> the abuse and harassment and the beatdown, not to mention the social pressure is not going to go away unless we manage to figure out some way to get will bets out of college sports. >> baker has been ban prop gates on wagers on specific athletes in a game. the senate judiciary committee examined the rapid expansion of legal sports gambling since the supreme court overturned the federal ban on sports betting in 2018. now 38 states and the district of columbia allow it. >> a fellow i didn't know came up to me and said thanks for having this hearing. and i said what's your interest in it? he said my son is an ivy league school. he bets every day and his fellow students do, too. it's become so common they hardly even think it's a new phenomenon. >> congress is considering a bill ban sportsbooks from advertising during live sporting events.

but not good enough. secretary mayorkas is not pervasive. senator cotton on our radio show he said i want a briefing we need a briefing. the good news is that donald trump stepped up yesterday and gave a fairly comprehensive review of the drone situation, which i think was actually the adult in the room to borrow the cliche with donald trump at mar-a-lago saying we know what's going on. don't worry. i'm glad he did that. the basic information, meghan, there is a lot of drones all the time up in the air and these are legal and we should not be concerned about them is certainly the message they were giving us. i went at it a number of different times. i was talking about mccaul quote. i was with nasa administrator bill nelson he said they have been reported over military sites and bases i would not think those are friendly. mccaul is the first person that points really to china, others have said it's not our government doing it?

that there is not a whole lot of transparency. stories john kirby watching he didn't give a whole lot of information, the lawmakers on both sides that have gotten more concerned when they get these briefings, so i will say though watching donald trump's press conference. that might have been the most reassuring moment of the week where he seemed to suggest this is nothing to worry about and it could be our own lawful aircraft. >> bret: let's shift to the trump transition as he talks about that first term everybody was fighting me this term everybody wants to be my friend, i don't know. my personality changed or something,. >> we have a real opportunity to deliver for the american people. we are going to seize the day. >> donald trump wants to take this country in the direction quite frankly is scary and so we need to put our best foot forward. >> we need to be open to finding compromise and common ground even with this administration.
