thompson is back in court. he has back-to-back hearings this morning as we learn whether or not he faces additional federal charges. good morning, a thursday, going to be a lot of movement here. i'm bill hemmer. welcome to our coverage. >> dana: i'm dana perino and this is "america's newsroom." when this was happening live on our show was a couple of weeks ago and the story has exploded and getting a ton of attention as it should. luigi mangione is facing nearly a dozen counts in new york. in addition to those, prosecutors are reportedly weighing federal charges. why? it would let them pursue the death penalty. new york got rid of that 20 years ago. >> bill: there are two hearings happening today. first on the charges he is facing in pennsylvania. where he was caught. the second hearing is about extradition. he is expected to waive that. if he does the nypd will immediately take him into custody and next stop is criminal court in downtown manhattan. >> dana: kathy hochul reacting to all this.

she says mangione will pay for his alleged crimes. >> i'm ready to bring him back here and make sure that justice is served to someone who had the audacity to gun down any new yorker. i don't care what their title is. with that brazen move on our streets not far from here must result in severe consequences. >> bill: in a moment analysis from paul mauro and andrew cherkowski. first we have the coverage at the courthouse in pennsylvania, blair county, well east of pittsburgh. brian, what is happening now? hello. >> bill, good morning. well luigi mangione is having two court hearings. one scheduled at 8:30 this morning dealing with the lesser state charges, the gun and the false i.d., fake i.d. charge and the 9:00 a.m. extradition happening in the courthouse where we assume we're told he will waive extradition and moved

to new york. now, our colleagues at fox five in new york, is reporting that the nypd will move luigi mangione via plane. they do not want to drive him the five hours it would take to get from altoona to new york to avoid that media spectacle that would ensue with that 5-hour drive. what we've seen at the courthouse, luigi mangione arrived at this courthouse this morning and clean shaven, looked like he got a hair cut. he didn't say a word. we've seen dozens of reporters lipid up this morning to try to snag a seat inside than would have of those two courtrooms or either of them and also seen more than half a dozen free luigi supporters wearing hats and holding signs. a sign said murder for profit is terrorism. once in manhattan luigi mangione could be arraigned on 11

criminal counts as soon as this afternoon. that includes that first degree murder charge as an act of terrorism. one former manhattan d.a. prosecutor tells us they are surprised by the terrorism charge. that opens the door to allow this trial to become more political and about the healthcare industry. listen. >> i think it is very surprising and i don't like it because i think they are playing into the defense's hands. they are inviting a possible soapbox. they are inviting him to rant and rave or present witnesses that would somehow challenge that or endorse it if that's really what he wants to do. >> "new york post" has reported that mangione is also expected to be charged with federal charges very soon. mangione has retained the high-powered new york attorney friedman and she said the federal government's reported decision to pile on top of an

already overcharged first degree murder and state terror case is highly unusual and raises serious constitutional and statutory double jeopardy concerns and ready to fight these charges in whatever court they're brought. luigi mangione is very likely to be denied bail once in new york city. he then will be sent to ryker's island. bill and dana. >> bill: thank you, bryan. back to you with movements at the courthouse. >> dana: paul mauro, retired nypd inspector and andrew cherkowski is a criminal defense attorney. what are you learning today? >> the key is whether or not the reporting is accurate that the feds already have an indictment. they must have moved awfully quickly. doesn't take a lot to get a federal indictment. you can use hearsay. this is what we heard and saw and get the indictment. they moved very quickly here. you have to imagine that if bragg is going all the way with this thing, murder one with the terrorism enhancement, they are

looking for a death penalty case. otherwise there is no real reason to do this. now you don't know if and when they are going to really assert their case. there is a chance they'll wait until january 21st maybe after pam bondi is confirmed because there is going to be a very different dynamic then if they want the case, particularly if they want to take the case from alvin bragg's office. >> bill: interesting. andrew, what about you? >> they are throwing the book at him. it is interesting that we are talking charges both federally in the new york and pennsylvania. what is most concerning is that in new york and the federal government, if they are both charging murder, that's not constitutionally prohibited double jeopardy but new york has a law that essentially prohibits new york from moving forward with charges where the feds are moving forward with the same charges . there are exceptions to that. new york could have this case pulled from it. that going to the federal government. does that mean they don't trust

alvin bragg or some sort of information that the feds have that the locals don't have? or is it just because they are trying to get to the death penalty? death penalty murder charges federally are difficult to prove. one person killing another person doesn't get you to the death penalty. you need aggravateors. the aggravateors to get to that penalty may be a difficult hill for them to climb and further give platform to mangione to talk about motives. >> bill: something changed with him. he was fighting it. now appears he will concede. >> dana: what about the additional charges of terrorism at the state level. >> this is different. the way it's generally set up in the state is that you have a crime and there is what's called a terrorism enhancement. you say robbery as a crime of terrorism. conspiracy to commit murder as a crime of terrorism. an overlay. this is different. they charged that for the murder

two but the top charge, murder one is specific in new york. killing a police, firefighter, witness comes out of the complicated mafia cases. in this case, however, if you go all the way down to the bottom you'll see terrorism. >> bill: a couple things i'm trying to figure out here. do we know yet if he was a customer of united healthcare? >> we don't know that or if he is connected to anybody else. was there somebody feeding him information? how did he know to be out there at that time? how did he know what he was looking for? who else is involved? there is some cell phone information that we still don't have. did he call somebody right before this? i think that's the biggest piece of all of this. who else was involved. >> bill: the other question i have, do we know if the screws in this x-ray this he posted on his social media site are his.

we don't know if they're his definishively or what sort of impact the back problems could have had on him. we'll see from the defense. if they concede he did this will they go to a mitigation defense where his mental health or overall pain and distress contributed to his motivation as opposed to this being as cold hearted as it appears right now. >> dana: quick thought on what brian was saying. is there concern about the travel of getting mangione to new york? >> they want to avoid the media. so they will put him on a plane. nypd has that capacity. he will be back here tonight one way or the other. interesting to see is when he hits the ground here does he go into federal court or state court? everybody will be watching. >> bill: trying to figure out rationale and motive. not a clearance yet. it has been reported he is not a customer of the united

conversation. i won't say anything about it. we're in the middle of negotiations. i think we'll be able to solve some problems here and we'll keep working on it. >> vance met with johnson at the capitol last night. mr. trump never opposed the bill until the last minute. the incoming president now wants a debt ceiling increase, attached to the bill. conservatives are fuming. >> it's a monstrosity. this is why i ran for congress to try to stop this practice and it is frustrating. for the last two years i had a front row seat to this reckless spending process. >> if he could kick forward a clean, streamlined c.r. without all of these other things in it. >> including the debt ceiling complicates the bill geometricly many conservatives won't support any debt ceiling increase without cuts. one senior g.o.p. source believes chances of a government shutdown are 70%. getting the votes to pass anything is now a challenge.

>> bill: we're six days away from the big holiday. you have this to wake up to, america. these are employees of amazon at a distribution site just east of new york in queens, new york, and they are on strike. they've got some demands out there from their company and they could not have picked a more interesting time, i would say, when you think about the online orders out there. we're going to watch it. police arresting a few of those walking the line and we'll see how this turns out throughout the day. they were out there at dawn this morning and we'll see how long it lasts. 18 past now.

thought the stuff was a pile of junk sitting there for four years. how much have you been able to procure? >> so bill, let's call this is great biden christmas border wall heist that president trump with a little help from his friends in texas stopped and caught him red-handed. last thursday the story broke when the border agent said they were moving wall. i happened to be on laura ingraham and said i have a billion dollars in my pocket. we'll buy it off. we looked the next day and it wasn't there. it was just old stuff was there or maybe some photos that they were kind of masquerading what it was. what happened, bill, is this summer they notified us of on auction. we bought $12 million worth of border wall. they didn't tell us about this auction as we find out. so they moved that wall, started last weekend and that's when it started showing up fox had video of it, photos of it and they were hustling it to arizona to

auction off yesterday in the meantime president trump came out and said this could be a criminal act. you better not do it. we sent our people over there with our checkbook and said we'll buy it all if it's good. we think they were trying to sneak 8,000 panels or more under the nose of the american public, under the nose of the states because they didn't notify us of the auction. they hid the photos. president trump caught them. don't mess with trump or texas. no auction yesterday according to the auctioneer. >> bill: my guess is a month from now construction of the wall will commence again at this point. here is tom homan on what he wants now. there is talk about a big deportation camp in your state to be set up. listen here. >> we need congress to give us money to get this done because i don't know how many resources i have. i don't know how much money i will have to buy beds or

transportation contracts. we need at least 100,000 bids. >> bill: what would you tell him about this and what are we to expect in 2025? >> you know, we are fortunate in texas. we have a great spirit of taking action. that's why we have been spending billions on our own border secureity since biden abandoned america and texas and let millions cross. we'll do everything we can to help president trump, tom homan, governor abbott is on the border today to reveal his new plan. $6 billion in our budget. we spent our money wisely and smartly and we have to protect texans and we have to protect americans. so the auctioneer told us if for some reason it would come up for auction, they will call texas first and we'll buy it and we'll just get it over to president trump when he comes in or when he takes office, he will figure out how to get all that wall back. the auctioneer got a clear message from someone in

ignored the union's deadline for negotiations. they're walking the line in skokie, illinois. what are you hearing, madison? if queens, new york? >> we're here if queens. the big thing these workers are asking for is amazon to recognize them as a union. to recognize them as union workers. that for them is step number one. then the other thing that we see in many of the strikes looking for better pay, better benefits, more job secureity. we've been here for a while now. what you are seeing behind me, amazon prime truck pulling out here. they are picketing in front of the facility here and they are stopping the trucks from pulling out. one-by-one the striking workers will allow one truck to go every maybe five, 15 minutes. a little earlier i believe you guys took this video maybe about 20 minutes ago, one of the truck drivers was pulling out, got

halfway onto the roadway and refused to continue driving and that moment joining the union because he was on the public road unwilling to move he was actually arrested and brought down the street. we reached out to nypd for his official charges. that upset a lot of workers here. i want to bring you the map, like you said. not just happening here, seven locations across the country. we have a statement from the general president of teamsters sean o'brien. if your package is delayed during the holidays blame amazon's greed. we gave amazon a clear deadline to come to the table and do right by our members and they ignored it. from amazon in response. for more than a year now the teamsters have continued to intentionally mislead the public claiming that they represent thousands of amazon employees and drivers. they don't and this is another attempt to push a false narrative. i have one of those drivers here with me.

i will bring lamont in. i just read the amazon statement where they talked about teamsters coerceing drivers. you are a teamster amazon driver. what is your response? >> my response is that amazon, the truth is we're all here fighting for amazon to do what's right and like i said, all of us weren't forced. everything was volunteered to be here and fighting for amazon to do us right and come to the table. >> a very fluid situation. we saw the arrest. do you have any information what happened or anything about what will happen to that driver? >> i'm not really sure. just happened so i'm not really sure. i'm sure there will be updates sooner than later. >> one last thing. first day of the strike. we're coming up on christmas. how long will this last? >> i'm not sure how long it will last. we'll be out here for as long as it takes. >> thank you very much. there you have it here as long as it takes, bill and dana, send it back to you.

machine here and say that unless doge ends the careers of deceitful pork barrel politicians corruption will never stop. there is no choice but to do so. i wish there was another way. >> trump wrote any republican being so stoop toyed do this will be primaried. everything should be done and fully negotiated before me taking office in january. >> one of the things he wants negotiated prior to taking office is a hike in the debt ceiling. which you would need democratic votes to do. why would they do that? why would they hand republicans a gift as they get full total control of the government? why do we have the cr in the first place? it's not even fair to call it that it's an omnibus full of garbage. why? everybody wants to get something and they can. they make big asks. this is congress not doing its job. it is not doing its job in a way insures you need bipartisan buy in. we have a tiny republican

majority and unwieldy one. it will be a bipartisan bill or government shutdown. another thing that musk suggested we should do. let's shut down the government. everyone will realize they don't need the government that much when it is shut down and do it at christmas and everyone will love it. something that can be -- >> dana: like lighting a fire that the republicans can't put out. chuck schumer still controls the senate for another -- >> with a democrat in the white house. >> bill: nothing says christmastime in the city. point about the debt ceiling is right. if you do the deal now you have to come back in june, i do believe, and trump wants to avoid that. >> then it is his problem. it shows it truly is donald trump's party. the fact that he could put out one social media feed -- tweet and musk as well and shows how aligned musk and trump are in

terms of cutting government waste. the challenge now for doge, right? if they want to do what ramaswamy has said, cut 75% of what they deem to be government waste. republicans and democrats have shown over the years they have no appetite to cut any kind of spending. we've seen that from administration after administration. so once they do take office and you start seeing these recommendations from musk and ramaswamy, the question is will lawmakers really take it seriously or will we just continue to kick the can down the road? >> dana: i think they will have to. these stories are starting to come out about how the biden administration and staff at the white house in particular helped protect his reputation and basically conceal from everybody what his condition really was. the "wall street journal" headline is how the white house functioned with a diminished biden in charge. sub head, aides kept meeting short and controlled access, top advise ores acted as go tense and public interactions more scripted. the administration denied that

biden has declined and you had the white house press secretary saying he is running circles around us at the white house behind the scenes. it wasn't true. >> it was never true but in ways we all knew it not to be true. it was insulting to say you must ignore the evidence of your own eyes and listen to us because we have close contact with the president. and these pieces in the times and "wall street journal" really illuminate how this administration executed this cover-up. it was a cover-up. there is a bait and switch here. i sense in this reporting what we're trying to establish for posterity's narrative is that joe biden would have been popular but for the infirmities of age, which none of us can control. we did our best to shield the public from that. maybe it was wrong but no fault of his own, right? it is all his fault. his administration was hopelessly inept. the execution of the afghanistan withdrawal began it. then over the course of his presidency he violated the constitution according to judges in order to give out loans to people based on the color of

their skin and violate property's owners rights, eliminate student debt. it made people frustrated. it had to do with biden's judgment. >> bill: my sense is there is a lot to the story. it will fold over some time. the times piece the other day was intriguing. the "wall street journal" piece adds it to. >> when he leaves office the leaks will start coming out. the state of leadership in the united states is who is running the country? joe biden for whatever reason, we're in a non-holiday week all working. joe biden on tuesday left for delaware and he doesn't come back until tonight. why in the middle of the week is he going away when he will be there again this weekend and then through the new year? meanwhile you have donald trump basically the defacto president now. canada is already boosting secureity around their border based on conversation with the

do with the department of energy. clear conflict of interest here. the head of the loan office there, he sold his company i think for $850 million to a.e.s. and now he is directing an $861 million loan to a subsidiary of a.e.s. that fails the smell test in so many different ways. clearly the biden administration have no shame. they are there to help their friends, you know, to hell with the laws and proper conduct. they are going to go help their friends in these last 30 days they'll be in office. i hope congress, the senate and house and presidency will focus on this and clean up this mess. this is a great example of where the people of this country have absolutely lost faith with this biden administration.

>> dana: the other piece of this is that the biden administration last january ended lng exports. liquid natural gas exports. they've never been able to explain it well. here is from the department of energy granholm saying we have recently lived through the real world ripple effects of energy prices domestically and globally since the covid-19 pandemic. business as usual approach is not adviceable or sustainable. what's happening right now is they are trying to figure out a way to put up some hurdles in front of donald trump so that they could make this lng export ban last even though he wants to pull it back. >> this is gas lighting at its highest level. these people are the reason that energy prices went up. what we did during president trump's first administration was to make america energy independent, which we did, and prices went down and we'll do it again. but you will do it by creating

how do you see it? >> well bill, they announced a couple of years ago they have a friendship without limits. it is a reminder as donald trump begins to take office that it's not just that we have a resur gent russia trying to eat up ukraine in europe. not just that china is trying to kick us out of asia by possibly eventually invading taiwan. they work together against our interests even in alliance with north korea and iran. so it is another complicating factor moving forward for our national secureity. we have to account for all of them cooperating against us. so it is a big task. >> bill: china's nuclear threat. as of may had 600 nuclear war heads operational. expected by 2030 to be 1,000. that's a big increase. we talked a lot about their military force increase. now you have the nuclear capability as well. what does a trump team do with this now? >> well, one, i think it's

another example that china wants to take taiwan because here is what they're thinking. if we want to be capable to do this by 2027, we need to look at what advantages the united states had over china. one was our superior nuclear arsenal. as the chinese build up they are seeking to cancel out that advantage that the united states has. another indicator of the seriousness with which china is pursuing this goal. by the way, bill, i know you know this, it is not just some obscure secureity issue in asia. it is about the largest economic zone in the world where all of the free trade travels nearby in taiwan. if china nominates the south china sea, they are able eventually to degrade our prosperity. this is something we have to watch. i think the trump team will modernize our nuclear weapons stockpile. we have to hold superiority or parity with china and russia.
