Description

In the division of powers between the European Institutions, the Commission has the general responsibility of initiating the legislative process  by proposing new EU law. The Council and the European Parliament adopt EU laws. Member States must implement and apply EU law correctly and in time. The Commission supports Member States in this process, for example through guidelines, expert group or committee meetings. The Commission is responsible for making sure that all EU Member States properly apply EU law. In this role, the Commission is referred to as the ‘guardian of the Treaties’. If Member States fail to properly implement EU laws, the Commission may launch a formal infringement procedure against the country in question. If the issue is still not settled, the Commission may eventually refer the case to the Court of Justice of the European Union.

Since 1984, the European Commission has been presenting annual reports detailing its actions to ensure compliance with EU law. Each edition outlines the enforcement measures taken over the past year to protect the rights and freedoms of people and businesses across the EU, highlights areas of successful compliance by Member States, and identifies where further efforts are needed.
